HOW THE RULES SPLIT

Once you bring on even one employee, though, that employee is almost always subject to mandatory coverage regardless of your own status as owner.

WHY MANY SOLO OPERATORS CARRY IT ANYWAY

Excavation is a high-severity trade: cave-ins, equipment injuries, and crush hazards don’t check whether you’re the owner or an employee before they happen. A sole proprietor without workers’ comp coverage on themselves is relying entirely on personal health insurance (if any) and out-of-pocket funds to cover a serious injury, with no wage-replacement benefit at all. Many GCs and municipalities also require a Certificate of Insurance showing workers’ comp coverage before they’ll let a sole proprietor on a job site, even one with no employees, which pushes solo operators to carry it voluntarily just to stay bid-eligible.
